What is Right to Repair?

Nations that want to harm the United States are actively trying to steal American IP and use it to weaken our national security and defense strategies. “Right to Repair” legislation would make our innovations vulnerable to foreign competitors and adversaries.

Congress must go back to the drawing board and create targeted legislation that would help improve military readiness without eroding the protection of trade secrets owned by manufacturers and innovative software companies and risking the exposure of sensitive trade secrets to the world.

I am writing today to urge your opposition to broad and unclear “Right to Repair” legislation.

While these proposals are intended to improve military readiness, they lack the precision needed to ensure privately funded intellectual property (IP) remains protected. This uncertainty would discourage investment and innovation, shrink the defense industrial base (DIB), and slow the delivery of critical capabilities to our warfighters.

America’s defense advantage depends on companies that invest billions of dollars – and years of work – to develop breakthrough technologies. Right to Repair would weaken those incentives by making it easier for aftermarket competitors to benefit from investments they didn’t make. Weakening IP protections makes it harder for businesses of every size to justify investing in new technologies and creates uncertainty about whether they can earn a return on those investments. When government reduces the value of innovation, it inevitably gets less of it.

The consequences would be felt across the DIB, especially by small businesses. Thousands of innovative suppliers rely on the IP they have developed to compete and grow. The Department of War has already reported a 40% reduction in small businesses in the DIB over the last decade. At a time when Congress is working to strengthen and grow the DIB, this legislation would discourage the very companies it is trying to attract and retain.

Right to Repair could also make the defense acquisition system slower and more complicated. New data rights requirements could introduce contracting delays, increase disputes and administrative burdens, and ultimately slow delivery of critical capabilities to our warfighters.

Congress can improve repair and sustainment without dismantling the IP protections that have helped make America’s defense industrial base the strongest in the world. In fact, Congress has already directed the Department of War to evaluate whether gaps in access to technical data are affecting military readiness. That work is not yet complete. Congress should not weaken IP protections before the Department of War has demonstrated that such a step is necessary to solve an identified readiness problem. Instead, Congress should pursue targeted, evidence-based reforms that address demonstrated sustainment challenges while preserving the incentives that drive American innovation and strengthen the DIB.

I respectfully urge you to oppose broad Right to Repair legislation and instead support balanced reforms that protect innovation, strengthen the defense industrial base, and ensure our military continues to receive the most advanced capabilities as quickly as possible.
